The accident happened on June 16, 2017, in the dark of night. Tatu Ganpat Gaikar was on his motorcycle when a reckless driver in a four-wheeler crashed into him. Gaikar suffered severe injuries and tragically lost his life at a rural Hospital in Shahapur.
Thane MACT has now decided to award Rs 16 lakh compensation to Gaikar’s family for the untimely loss. Despite the driver of the vehicle not having a valid license at the time of the accident, the responsibility to pay the compensation falls on the insurer, Bajaj Allianz General Insurance Company Ltd. The insurer can then recover the compensation amount from the vehicle’s owner.
The accident was a result of the negligence of the offending vehicle’s driver, as per police documents. The insurer, Bajaj Allianz, argued that the driver was unlicensed and the vehicle was being used for hire against policy conditions. However, MACT member S N Shah’s judgment favored Gaikar’s family, ordering the insurer to deposit the compensation amount with interest within a month.
The compensation will be shared between Gaikar’s widow and son, with a significant portion to be kept in fixed deposits for five years. This decision brings some closure to the family who has been grieving the loss of their loved one since that fateful night in 2017.
On another note, over 100 people have been charged for participating in unauthorized protests in Thane district. Despite prohibitory orders under the Maharashtra Police Act, these protests took place at six locations in the Mumbra area. This incident serves as a reminder of the importance of following the law and obtaining permission for public gatherings to ensure safety and order.
